Judicial Review Challenge - COUNCILLORS have voted to support Essex County Council’s judicial review challenge of Local Government Reorganisation.

COUNCILLORS have voted to support Essex County Council’s judicial review challenge of Local Government Reorganisation.
Rochford District Council councillors agreed a series of recommendations that support a pragmatic and practical approach to Local Government Reorganisation (LGR) in Essex.
Under Government plans, LGR will see the abolition of all existing 15 local authorities in Essex and the creation of five entirely new Unitary authorities. Under these proposals, Rochford District Council would form a new Unitary Council, the South East Essex Council, along with Castle Point and Southend.
It is these proposals that are currently being challenged by Essex County Council via a judicial review.
At Full Council on Tuesday 17 July, councillors agreed to support, as an interested party, Essex County Council’s judicial review challenge to the Secretary of State for Housing, Communities and Local Government’s decision of 25 March 2026 on his preferred option for the reorganisation of local government in Greater Essex.
Councillors also agreed that Rochford District Council will continue to engage in ongoing preparatory work for the reorganisation of local government in Greater Essex pending the outcome of the judicial review proceedings.
As part of the preparatory work for the establishment of the new unitary council, the Leader of the Council, Coun Adi Malviya and Coun Danielle Belton will represent Rochford District Council on the Joint Committee along with councillors from Essex County Council, Southend Council and Castle Point Council.
This Joint Committee will support LGR collaboration and transition arrangements through to when the Shadow Authority is elected in May 2027.
Coun Malviyahsaid: “Protecting local services and getting the best deal for residents and businesses in our district is first and foremost of everything – it’s what we are here to deliver.
“We need a pragmatic approach though.
“We will support, as an interested party, Essex County Council’s judicial review challenge of the Secretary of State for Housing, Communities and Local Government’s decision in March, but at the same time ensure Rochford District Council is engaged in the preparatory work of the new Unitary council.
“Our decisions at last night’s meeting at Full Council support that approach and mean our district will be represented in both the legal proceedings and Local Government Reorganisation discussions and preparatory work.”
